Aplazan para el 4 de septiembre medidas cautelares envasadoras Propagas
Santo Domingo, RD.-El Tribunal Superior Administrativo aplazó para el martes 4 de septiembre el conocimiento de las medidas cautelares interpuestas por cinco envasadoras de Gas Licuado de Petróleo de la empresa Propagas (Propano y Derivados) que busca dejar sin efecto el pago de multas impuestas por Pro Consumidor por irregularidad en la venta del GLP a los usuarios.
La jueza del Tribunal Superior Administrativo, Delfina Amparo de León Salazar, también se reservó el fallo para el martes 4 de septiembre de la solicitud de levantamiento del embargo retentivo a las cuentas bancarias de los ejecutivos a la empresa Propagas (Propano y Derivados).
La magistrada De León Salazar aplazó las medidas cautelares acogiendo una solicitud de los abogados de Instituto Nacional de Protección de los Derechos del Consumidor (Pro Consumidor) para depositar nuevos documentos que forman parte del expediente.
Entre esos documentos se indica el nuevo reglamento para la comercialización del GLP (Gas Licuado de Petróleo), aprobado por la Dirección General de Normas y Sistemas de Calidad (Digenor).
Las medidas cautelares interpuestas por Propagas (Propano y Derivados), buscan dejar sin efecto las multas que les impuso Pro Consumidor mediante las resoluciones 058-2012, 060-2012, 064-2012, 125-2012 y 356-12 por venta irregular de GLP a la población.
Las cinco plantas envasadoras propiedad de la empresa Propagas fueron multadas con 4 millones 349 mil 625 pesos.
Las envasadoras sancionadas por Pro Consumidor por venta irregular de GLP están ubicadas en el kilómetro 9 de la autopista Duarte; Los Girasoles; Santiago, Higüey y Jarabacoa.
La envasadora del Kilómetro 9, de la autopista Duarte fue multada con 500 salarios mínimos equivalente a 2 millones 558 mil 500 pesos, tras detectarse irregularidad en la venta del GLP, en once dispensadores de dieciséis que tiene la planta.
La de Los Girasoles fue sancionada con una multa de de 50 salarios mínimos, equivalente a 255 mil 875 pesos porque de cuatro dispensadores que tenía para el despacho del combustible uno estaba alterado afectando a los consumidores.
La planta de Santiago, ubicada en la avenida Joaquín Balaguer, fue multada con cien salarios mínimos, equivalente a 511 mil 750 pesos, porque de ocho dispensadores tenía dos alterados.
La de Higüey, ubicada en la carretera Higüey La Otra Banda, fue multada con cien salarios mininos, equivalente a 511 mil 750 pesos. La de Jarabacoa, la multa fue de cien salarios mínimos porque de dos dispensadores uno estaba alterado perjudicando a las amas de casa.
Supligas es otra envasadora que fue multada por Pro Consumidor, con cien salarios mínimos equivalente a 511 mil 750 pesos.
Pujols
El consultor jurídico de Pro Consumidor, Félix Pujols, dijo esperar que el Tribunal Superior Administrativo aplique en buen derecho lo que ya ha demostrado con otras sentencias en las que ha rechazado solicitudes de medidas cautelares de plantas envasadoras que por esa vía han pretendido evadir el pago de las multas que les han impuesto por violación a la Constitución y a la Ley 358-05 sobre protección de los derechos del consumidor y usuario.
Otras plantas pagaron
Sin embargo, pese a que las empresas grandes incoan medidas cautelares para evadir el pago de las multas que les impuso Pro Consumidor por venta irregular de GLP, las pequeñas sancionadas por las mismas prácticas irregulares han honrado sus compromisos.
Entre éstas se citan las envasadoras Credigas, de la Carretera Mella; envasadora Unidos-Asogas; envasadora Galán y envasadora La Moderna, de San Cristóbal, las cuales comenzaron a pagar las multas que les impuso Pro Consumidor.
De acuerdo a la entidad garantista de los derechos económicos de la población, la responsabilidad social de una empresa consiste en el cumplimiento de la Ley y de sus deberes en la sociedad.
