Crecen las demandas judiciales de los argentinos por trabas a la compra de dólares
Buenos Aires.- La Justicia argentina se prepara para recibir varias demandas de consumidores en rechazo a las restricciones que impone el Gobierno a la compra de dólares, que potenciaron los circuitos informales y motivaron «cacerolazos» en algunos barrios de Buenos Aires.
La asociación civil bonaerense «Sepa Defenderse» prepara la presentación de una acción colectiva ante los tribunales para reclamar que el Fisco detalle cuál es la fórmula que aplica para rechazar la adquisición de divisas por parte de la población, anticipó a Efe el presidente de la entidad, Pablo Rodríguez.
La organización considera que la Administración Federal de Ingresos Públicos (AFIP) emplea un «mecanismo arbitrario» en los controles que realiza desde noviembre pasado a cada una de las operaciones con dólares en casas de cambio y bancos, añadió el titular de la asociación civil de defensa al consumidor.
«En los últimos días recibimos unas 60 o 70 denuncias de personas que tienen problemas por la restricción de dólares. Los reclamos proceden de todas las clases sociales, desde aquellos que no pueden viajar al exterior hasta quienes deben pagar una prestación médica valuada en dólares o comprar un pequeño terreno para una vivienda modesta», explicó Rodríguez.
En los próximos días, «Sepa Defenderse» también presentará otras cinco demandas judiciales individuales para reclamar la habilitación a la compra de dólares, el refugio favorito de buena parte de los argentinos.
Una de las primeras acciones judiciales presentadas fue la de un jubilado al que no le autorizaron adquirir 10 dólares que quería regalar a sus nietos.
«Fue a hacer una denuncia a la AFIP y le dijeron que era inconsistente. Volvió a la casa de cambio, intentó comprar un dólar y también fue rechazado», detalló el abogado Luis Moliterno, representante del jubilado Julio César Durán.
Así, los rechazos a las operaciones con divisas se multiplicaron en las casas de cambio y bancos, donde los compradores deben esperar a que el Fisco apruebe la adquisición mediante un sistema informático.
A esta situación se sumaron días atrás nuevas regulaciones para las compras de divisas estadounidenses para viajar o la adquisición de viviendas a través de créditos hipotecarios.
Las medidas crecieron en momentos en que el Gobierno de Cristina Fernández se prepara para hacer frente a vencimientos de la deuda externa y registra un menor ingreso de divisas por exportaciones, que cayeron en abril un 6 por ciento en comparación al mismo mes del año pasado.
«Nosotros entendemos que este sistema es ilegal porque viola principios constitucionales. Hay que buscar una solución a través de la Justicia», evaluó Rodríguez.
De todas formas, la Justicia bonaerense rechazó el año pasado una medida cautelar presentada por «Sepa Defenderse» poco después de que se iniciaran los controles.
«La Justicia consideró que, al tratarse de una compra de dólares para el ahorro, la adquisición podía esperar. Pero ahora hay otros problemas con las restricciones a los viajes y al pago de inmuebles», postuló Rodríguez.
Las nuevas normas hicieron resurgir los circuitos informales de compraventa de divisas, donde hay que pagar, según medios locales, unos 5.90 pesos para hacerse de un dólar, cuando el precio en bancos y casas de cambios es de 4.49 pesos.
El senador oficialista y exjefe de Gabinete Aníbal Fernández estimó que la brecha entre el dólar oficial y el paralelo se reducirá el próximo lunes a partir de un aumento en la cotización de la divisa en casas de cambio a 5.10 pesos por dólar.
«Hubo una reunión ayer (viernes) con los representantes de las casas de cambio, hasta lo que yo conozco. Estarían abriendo a 5.10 pesos» el lunes, indicó el legislador en declaraciones a radio Mitre.
El jefe de Gabinete argentino, Juan Manuel Abal Medina, criticó el miércoles la «obsesión compulsiva» por los dólares que hay en parte de la sociedad y defendió las medidas para «desdolarizar» la economía que estableció el Gobierno.
Mientras, el viceministro argentino de Economía, Axel Kicillof, aseguró este viernes que «no existen» planes de «pesificación» en el país, tal como sugirieron versiones periodísticas.
En la declaraciones juradas de varios funcionarios, sin embargo, figuran ahorros en dólares, entre ellos Aníbal Fernández, quien admitió tener unos 25,000 dólares que compró porque «se le antoja», aunque más tarde se arrepintió de sus afirmaciones.
Las medidas causaron el rechazo de vecinos de algunos barrios de Buenos Aires, que el pasado jueves y viernes protagonizaron «cacerolazos» contra las restricciones. EFE
