Senado aprueba Proyecto de Reforma Fiscal con votos de 30 legisladores
Santo Domingo, RD.- El Senado aprobó de urgencia este viernes, en dos lecturas consecutivas, el Proyecto de Reforma Fiscal que favorece a empresarios del transporte de pasajeros y de carga, con la renovación de sus unidades, mediante el cobro de dos pesos por galón de gasolina consumido en el país.
Los 30 senadores presentes en el hemiciclo votaron a unanimidad a favor del proyecto, mientras que Carlos Castillo, de San José de Ocoa se excusó, Amable Aristy de La Altagracia no estuvo presente.
El referido proyecto pasa ahora a la Cámara de Diputados que convocó a sesión para el próximo martes para su debate.
Luego de leer el informe de la Comisión Bicameral, el senador Heinz Vieluf, solicitó que se incluyera en la orden del día y se declarara de urgencia para que fuera conocido en dos lecturas consecutivas, lo cual fue aprobado a unanimidad.
El Proyecto de Reforma Fiscal establece que para promover el desarrollo vial y la renovación del Parque Vehicular del transporte público de pasajeros y de carga, se establece un impuesto adicional de RD$2.00 por cada galón al consumo de gasolina y gasoil, regular y premium, previsto en la Ley 112-00 sobre Hidrocarburos.
El párrafo III de este artículo, índica que “el 25% de estos ingresos deberán ser utilizados exclusivamente para el programa de renovación vehicular de transporte público de pasajeros y de carga, cuyo diseño deberá ser coordinado con los representantes del sector transporte. El 75% restante será utilizado para el desarrollo vial”.
En los cuanto a los pequeños negocios como frituras y otros establecimientos de ventas de mercancías al por menor, incluyendo bares y restaurantes, que tengan compras mensuales superior a RD$50,000, pagarán de RD$12,000 anuales.
La pieza también precisa en párrafo IX del artículo 24, que “los montos del impuesto selectivo al consumo establecidos en el párrafo V del artículo, serán ajustados trimestralmente por la tasa de inflación, según las cifras publicadas por el Banco Central a partir del 2016”.
El párrafo II indica que en “adición a los montos establecidos en la tabla del párrafo I y a las disposiciones del párrafo II del presente artículo, los productos de alcohol, bebidas alcohólicas y cerveza pagarán un impuesto selectivo al consumo del 10% sobre el precio al por menor de dichos productos.
En lo referente a las compras por internet, en el artículo 54, elimina la exención a las mismas, imponiendo el cobro de impuestos a todas las mercancías de bajo valor que se importan a través de empresas de envíos (Couriers).
Sobre los juegos de azar, loterías, sorteos, rifas benéficas, casinos y establecimientos de juego de azar, máquinas tragamonedas y otros juegos electrónicos, bingos y de cualquier otra índole, para operar en el país, deberán solicitar su licencia en el Ministerio de Hacienda, al igual que el traslado de bancas de lotería y deportivas.
En lo referente al patrimonio inmobiliario, el mismo será gravado a partir de los RD$6.5 millones, en vez de los RD$5.0 millones que establecía el proyecto original.
Asimismo, en la pieza se acogió eliminar parcialmente el artículo 40 del proyecto original, en lo relativo a que en un plazo de 60 días, se modificaría la Ley 28-01 tendente a limitar los incentivos a algunas empresas y evitar la competencia desleal.
También, excluye el impuesto que grava a las Organizaciones No-Gubernamentales (ONGs y Cine) vinculada a la educación, salud y educación; no serán gravados los salones de bellezas, ni la peluquería y se eliminará el 10% de las propinas en los restaurantes.
Además, no se gravará la producción cinematográfica y se reducirá de un 5 a un 3.5% la venta nacional de las empresas de zonas francas.
